What is California Proposition 65 “Prop 65”?
California Proposition 65, also referred as the Safe Drinking Water and Toxic Enforcement Act of 1986, is a regulation with the main purpose of addressing concerns about exposure to toxic chemicals known by the state of California to potentially cause cancer, birth defects or other reproductive harm. Prop 65 requires businesses to provide a “clear and reasonable” warning on consumer goods in order to alert the individual before an exposure can take place.
Effective August 30, 2018, Prop 65’s warning requirements changed in order to expand business’ obligations under the law. Under Prop 65, businesses (including manufacturers, distributors, and retail sellers) must provide “clear and reasonable” warnings for products containing chemicals on the Prop 65 chemical list to both consumers and down-stream manufacturers. In addition to on-product warnings, the required warnings must also be included in catalogs (where purchases can be made), and on webpages or at check-out for internet/ecommerce sites - so that consumers in California can see the warnings prior to purchase.
How is Sensata responding to Prop 65?
In order to comply with this regulation, Sensata Technologies has assessed that many of its products contain substances that are found on the Prop 65 list, and therefore require such warnings. These chemicals include but are not limited to Nickel, Lead, Cadmium, and Beryllium. Sensata has decided to place a warning label on each product’s packaging, where required in order to alert our direct and indirect customers.
Although Prop 65 only applies in California, we sell to many companies that use Sensata products in their own products, and then sell to a variety of global markets. If materials in our products require a warning, it is Sensata’s responsibility to inform other manufacturers and distributors we sell to, so they can provide the appropriate warnings if they ultimately sell into California.
